Welsendevs, along with its subsidiaries (collectively referred to as " Welsendevs,""We," "Us," or "Our"), provides access to www.welsendevs.ai and other websitesoperated by Us that link to these Terms of Use (collectively and individually, the"Websites"). By accessing and using the Websites, you agree to be bound by theseTerms of Use ("Terms") and Welsendevs’s Privacy Policy.

If you do not agree to theseTerms, you are not permitted to access or use the Websites. Additionally, when using the Websites, you must comply with any guidelines or rules that are posted and may be updated periodically. These guidelines or rules are incorporated by reference into theseTerms.Should there be any conflict between these Terms and any statement of work, master service agreement, or any other service agreement concluded with Welsendevs (“Service Agreement”), the Service Agreement shall prevail.

We will inform you of any significant changes by posting the updated Policy on our Websites. It is advisable to review this Policy regularly for any updates. We may also provide "just-in-time" disclosures or additional information regarding our data collection, usage, and sharing practices for specific services.

1)Updating Terms. We may modify these Terms, including adding or removing any part, at any time. Such modifications, additions, or deletions (“Modifications”) will become effective immediately upon posting. By continuing to use the Websites after such posting, you agree to accept these Modifications.

2)Changes to Websites. Welsendevs may change or discontinue any aspect, service, or feature of the Websites at any time, including, but not limited to, content, availability and equipment needed for access or use.

3)Registration. You may have the opportunity to register via an online registration form or by participating in Interactive Areas, such as feedback forms, forums, and other community features, to create a user account (“Your Account”). This account may allow you to provide feedback to users of our services and/or Websites (“Users”),receive information from Us or Users, and/or participate in certain features on theWebsites. We will use the information you provide in accordance with our PrivacyPolicy. By registering, you represent and warrant that all information provided on the registration form is current, complete, and accurate to the best of your knowledge. You agree to maintain and promptly update your registration information on the Websites to ensure it remains current, complete, and accurate. You are responsible for obtaining and maintaining all connectivity, computer software, hardware, and other equipment needed for access to and use of the Websites, as well as all related charges.

4)USER CONTENT GUIDELINES:When you submit User Content or engage in an Interactive Area on the Websites, youagree not to upload, post, or transmit any User Content that

a) breaches or infringes upon the rights of others, including any content that may defame, harass, stalk, or intimidate others;
b) you are aware is false, deceptive, or incorrect;
c) features clear instances of bigotry, racism, ethnically or racially offensive material, hate speech, abuse, vulgarity, or profanity;
d) includes or promotes pornography, sexually explicit material, pedophilia, incest, bestiality, or any content that is otherwise obscene or indecent;
e) breaches any law or promotes or instructs on dangerous, illegal, or predatory actions, or discusses unlawful activities with the intent to carry them out; f)supports violent behaviour;
g) represents a significant threat to individual or public safety;
h) features violent imagery of killing or physical abuse that seems to have beencreated primarily for exploitative, sensational, or gratuitous reasons;
i) is protected by copy right, trademark, trade secret, right of publicity, or any other proprietary rights without the explicit consent of the rights holder. It is your responsibility to ensure that any User Content you submit does not infringe on these rights. You will be solely liable for any damage or harm resulting from such infringements. Any individual deemed by Welsendevs, at its sole discretion, to have violated intellectual property or other rights will be prohibited from posting or submitting any further material on the Websites.
j) isnot relevant to the intended topic or theme of any Interactive Area;
k) includes any unsolicited or unauthorized advertisements or promotional content related to products or services, such as "junk mail," "spam," "chain letters," "pyramid schemes," or other forms of solicitation; or
(l) utilizes the name or likeness of a recognizable individual without their consent.

You agree not to upload, post, or transmit any User Content, software, or othermaterials that may include a virus or any other harmful or disruptive elements.You agree not to employ any service, technology, or automated system to artificiallyboost the page views of your User Content.

This prohibition includes pay-per-click services, web “robots,” and any other existing or future technologies. Additionally, you agree not to instruct any third party to utilize these services, technologies or automated systems on your behalf. You agree not to imply or suggest, either directly or indirectly, that Welsendevs endorses any User Content.

You agree not to use any technology, service, or automated system to upload UserContent at a rate that exceeds what a single individual could reasonably manage in a given timeframe.Any behaviour that, in Our sole discretion, restricts or inhibits others from using or enjoying the Websites will not be permitted. We reserve the right, at Our sole discretion, to remove or modify User Content that you submit.

We reserve the right, though we are not obligated, to monitor User Content posted or uploaded to the Websites to ensure compliance with these Terms, any operational guidelines we establish, and any applicable laws, regulations, or government requests.While we are not required to monitor, review, edit, or remove User Content, we retain full discretion to review, edit, reject, or remove any User Content at any time, for any reason, and without prior notice. You are solely responsible for maintaining backup copies and replacing any User Content posted to the Websites at your own expense.Our decision to monitor or modify User Content does not imply any responsibility or liability on our part concerning your use of Interactive Areas on the Websites.

We are not responsible for the accuracy or reliability of any User Content and assume no liability for any actions you may take based on User Content posted on the Websites.Through your use of Interactive Areas, you may encounter content that you find offensive, objectionable, harmful, inaccurate, or misleading. Additionally, there may be risks associated with interacting with minors, individuals acting under false pretences, international trade issues, or foreign nationals. By engaging with Interactive Areas, you accept all associated risks.

When you submit User Content to the Websites, you provide us with a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, publish, reproduce, modify, adapt, edit, translate, create derivative works from, integrate into other materials, distribute, and sublicense (through multiple tiers) the User Content in any form, media, or technology, whether existing now or developed in the future, without any payment or compensation to you or any third parties. Additionally, to the fullest extent permitted by law, you waive any moral rights associated with the User Content and agree not to claim or enforce such rights against us. You affirm that you have the complete legal authority to grant us this license, that you hold or control all required rights to the User Content for the purposes outlined and that neither the User Content nor its use by us will breach these Terms, infringe upon any rights, including privacy or publicity rights, or cause harm or legal issues to any person or entity. Additionally, youauthorize us, though we are not obligated, to pursue legal action against anyone who violates your or our rights regarding the User Content by breaching these Terms.

User Conduct Guidelines: The following terms regulate your conduct while accessing or using the Websites:

(a) You agree not to disrupt or interfere with the Websites, or the servers and networks associated with them, and to comply with all applicable requirements, procedures, policies, or regulations of those networks.

(b) You agree not to reproduce, duplicate, copy, sell, resell, or use any part of theWebsites, their functionality, or access for commercial purposes.

(c) You agree not to violate another User's privacy rights by collecting personal information about them or sharing private details about others.

Users of Paid Subscription Services.As part of a paid subscription, you may initiate a new project identified by a unique project identification number assigned by us ("Project"). We reserve the right to closeProjects if you do not provide feedback or confirmation of completion within fifteen (15) calendar days from the delivery of any Service, regardless of whether the project is complete. Additionally, we reserve the right to close a Project if it remains ongoing thirty(30) days after you have been notified that the Project has started and you have not provided any feedback to Welsendevs. Subject to the terms of the Service Agreement, we will offer reasonable support to start a new Project for any remaining work.

Disclaimer of Warranties and Limitation of Liability

‍(A) YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE WEBSITES IS ATYOUR OWN RISK. WELSENDEVS, ITS AFFILIATES, AND THEIR RESPECTIVE EMPLOYEES, AGENTS, CONTRACTORS, THIRD-PARTY CONTENT PROVIDERS,THIRD-PARTY SERVICE PROVIDERS, OR LICENSORS DO NOT GUARANTEE THAT THE WEBSITES WILL BE FREE FROM INTERRUPTIONS OR ERRORS. THEY MAKE NO WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USING THE WEBSITES, NOR DO THEY WARRANT THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE OFFERED THROUGH THE WEBSITES.(

B) THE WEBSITES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE,MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT FOR WARRANTIES THAT CANNOT BE EXCLUDED, RESTRICTED, OR MODIFIED UNDER APPLICABLE LAW.

(C) TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELSENDEVS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, SUBSTITUTE GOODS OR SERVICES COST, DATA LOSS,GOODWILL DAMAGE, WORK STOPPAGE, TECHNOLOGY MALFUNCTION, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM THE USE OF THE WEBSITES OR ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, OR DELAY IN SERVICE, OPERATION, OR TRANSMISSION OF THE WEBSITES, OR ANY COMPUTER VIRUS, COMMUNICATION FAILURE, THEFT OR DESTRUCTION OF PROPERTY, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD, CONTENT, OR TECHNOLOGY RELATED TO THE WEBSITES. FURTHER, YOU ACKNOWLEDGE THAT WELSENDEVS AND ITS AFFILIATES ARE NOT RESPONSIBLE FOR ANY ACTUAL OR ALLEGED DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF USERS OR THIRD PARTIES ON THE WEBSITES. IF APPLICABLE LAW PROHIBITS ANY OR ALL OF THE ABOVE LIMITATIONS OF LIABILITYFROM APPLYING TO YOU, THEN SUCH LIMITATIONS WILL ONLY BE ENFORCED TO THEMAXIMUM EXTENT ALLOWED BY LAW.

(D) We assume no responsibility or liability for any unauthorized access to or use ofyour personally identifiable information. By using the Websites, you acknowledge andaccept this limitation of liability. If you do not agree with this disclaimer, you shouldrefrain from accessing or using the Websites.
